This privacy policy details how I use personal information collected by this site www.ghillankenton.com and also how I use personal information collected in person for the purpose of providing movement classes. Please read this privacy policy before using the site or submitting any personal information. By using the site and our services, you are accepting the practices described in this privacy policy. These practices may be changed. Any changes will be updated here and changes will only apply to activities and information going forward and not on a retroactive basis. You are encouraged to review the privacy policy whenever you visit the site to make sure that you understand how any personal information you provide will be used.

What kind of personal information do I collect?

  • Personal and contact details such as first name, surname, email, address and phone number

  • Your date of birth, and age

  • Emergency contact information

  • Information about your health and lifestyle – only when relevant to ensure safe participation in a class

  • Class attendance – including dates of past and future appointments and missed appointments

  • Records of your contact with me

  • Financial and transaction data for accounting purposes only. Please note that I do not collect or store credit or debit card details.

  • Mailing list details name and email address. The mailing list is for those who wish to receive information about classes and occasional email newsletters. Joining the mailing list is optional and requires that you to double opt in to consent to receiving emails. The mailing list will be refreshed every 2 years to ensure it is still relevant to you and you have the right to unsubscribe at any time.


Collection and use of your information

Most personal information is submitted in person through the completion of an enrolment health screening form and a consent/waiver form.

Personally identifiable information (like names, postal addresses email addresses etc.) are only used to fulfil your specific request, unless you give me permission to use it in another manner, for example to add you to one of my mailing lists. Personally identifiable information is used to register you in the program of your choice and update you when required of any possible changes to the planned services.

On my enrolment form I collect health information and other information (age, gender etc) only when relevant to the design of a safe movement/exercise regime and for the purpose of insurance. I also collect emergency contacts as I have a duty of care to you and your family.

In the case of regular classes and private sessions, I may keep my own records of those sessions to ensure a progressive and relevant program.

Personal information collected is done so using the lawful basis of consent. Where health information is concerned this is collected using the lawful basis of legal obligation. As a movement teacher I have a professional duty of care to my clients and I abide by the best practice guidelines of the industry and professional bodies I am affiliated to including REPS and IPTA. I am required to keep relevant health information to fulfill insurance obligations and for delivery of a safe exercise program. I am also required to keep payment information to fulfill tax purposes.


Storage of Personal Information and general security measures

All paper enrolment forms are stored in a secure place or scanned and stored electronically with password protection. Records of private sessions and other data is I hold is stored electronically and password protected.

Please bear in mind that no method of transmission over the Internet, or method of electronic storage, is 100% secure. I cannot ensure or warrant the security of any information you transmit to me and you do so at your own risk. If you believe your Personal Data has been compromised, please contact me and if I learn of any security or data breach, I will inform you of the occurrence in accordance with applicable law.


Distribution of Information

All information I receive from you and any correspondence that takes place is treated with confidentiality. I will never sell any of your personal data and I will never buy information about you, or anyone else.

Your personal information will not be shared with any third party other than platforms and technologies required to service my business (see third party vendors below) or if I am required by law to share information with governmental agencies in the event of fraud prevention or investigation. I will not share health information unless there there is medical reason to do so and your full consent has been given in writing.


Data Retention.

I will retain your Personal Information for as long as needed or permitted in light of the purpose(s) for which it was obtained and consistent with applicable law. The criteria used to determine these retention periods includes:

-the length of time I have an on going business relationship with you and provide services to you.

-whether there is a legal or insurance obligation to which we are subject (for example, insurance requirements and certain laws require me to keep records for a certain period of time before I can delete them, generally speaking this is 7 years).


Keeping my records accurate

I aim to keep any information about you as accurate as possible. If you would like to review or change any of the details you have supplied, you may do so at any time by simply contacting me. I may also ask you to update your health form periodically to ensure a safe exercise program can be delivered.


Deleting Information.

You can ask to un subscribe from my mailing list at any time by using the link at the bottom of the newsletters or by contacting me over the phone or by email and making a request.


Your rights

  • You have the right to request access to personal information I store about you and to obtain information about how I process it.

  • You also have the right to request that I erase all personal data about you (the “right to be forgotten”). Please note that this would not apply to any information for which I have a duty to keep for insurance or tax purposes.

Mailchimp: When you sign-up to my newsletter or request to be added to my newsletter distribution, your email address is transferred to the email marketing platform Mailchimp through which I send you the newsletter and updates.
